Dadar Police have registered an FIR against eight senior staff of Motilal Oswal Financial Services Ltd (MOFSL) for allegedly outraging the decency of a female colleague, whom the company suspended following complaints that she put “her colleague male sexually uncomfortable”. The FIR under Section 509 (Speech, gesture or act intended to insult the modesty of a woman) of the Indian Penal Code was registered at Dadar Police Station on Wednesday.

HR Manager and MOFSL Board Member Sudhir Dhar, Associate Manager Gaurav Manihar, Deputy Operations Manager Rohit Singh, Senior Manager Ankit Jobanputra, Group Senior Vice President Vijay Agarwal, Senior Manager (Legal) Rohan Adawal and Client Advisors Prince Sharma and One Suraj Pawar have been appointed in the FIR. The company said it would go to court to overturn the FIR.

The complainant, 37, is Assistant Vice President, Digital Marketing, at Prabhadevi-based MOFSL. She has been under suspension since May 6 for allegedly sending messages to her male colleague that made him feel uncomfortable. “After the suspension, MOFSL did not contact me or ask for my help in its so-called internal investigation. Because my suspension is illegal, I was forced to approach the police and the media,” a she said at midday.

“After learning that I had taken the legal route to deal with their high-handedness, the company extended my suspension. are pushing for my resignation,” she added.

She alleged that the MOFSL even asked a former “member of parliament (MP) to call me and ensure justice, and let it be known that he accepted the flaws in the system, and ask about my desired conditions. I have call logs to support my statement. And Motilal Oswal himself called this MP,” she claimed.

“All these men, against whom an FIR has been registered, are still in the pay of the company. But I am still under an illegal enforced prolonged suspension, even though the so-called fabricated complaints have not been proven,” she added. “People who have sat with me and shared their sex lives, bed conversations, celibacy, etc. have filed complaints against me citing sexual discomfort,” she said.

MOFSL refutes its allegations

The company, in a midday statement, denied its “baseless” claims. “We are filing an appeal in cassation with the competent court. Her behavior within our organization was toxic and she made her colleagues very uncomfortable. She is suspended based on complaints received from various employees working with her and this was communicated to her via email. The notice of suspension does not mention any allegation of sexual misconduct made against the employee, which she claims.

Stating that an independent committee was investigating the matter, the company said it was told to attend the first meeting, but did not join. “The committee sent him the updates and statements for his response, which is still awaited.”

“We also learned that she has done similar activities in the past. You can independently check his background with the suburban police station. The case is pending and a new decision will be made based on the decision of the independent investigation committee, which has not yet been made,” MOFSL said.
